Father & Son Face Second Trial on Animal Cruelty Charges

      As Rocky Mountain Rider Magazine goes to press, Craig and Curtis Heydon, the father and son convicted of 21 counts of animal cruelty in a Ravalli County Justice Court in February, 2009, will be facing another jury in Montana Judicial District Court in Hamilton, Montana, beginning February 22, 2010.

      The trial is scheduled to last five days, will be presided over by Judge Jeffrey Langton. Twelve jurors will decide the outcome.

      The Heydons, who live in Georgia , were charged with animal cruelty after being on a back country camping trip with four horses during the summer of 2008 in the Selway-Bitterroot Wilderness in Montana and Idaho . A jury of six unanimously declared them guilty on all charges, and the Heydons’ lawyer immediately appealed.

      Due to Montana law, an appeal in Justice Court means that a Montana Judicial District Court may try the case again, unless a plea agreement is met. The Heydons and Ravalli County Attorney’s office failed to reach an agreement.
